This is about my dishonest landlord Luz Masso who lives in Freeport New York. Mrs Masso's financial issues are not mine. She always received the rent on time each month and even called me to let me know she received my check.. However in January the air conditioner broke. I got several quotes for repairs as requested by Mrs Masso. It's the end of Fed and still no repairs. Mrs Masso said she has NO money and has already spent my last/ security and pet deposit. She has since put the unit for sale(Short Sale) at 200 Leslie Drive #1025 Hallandale Beach Florida. Just watch out for dishonest landlords who want a large deposit before moving in. This could be a red flag that they are in trouble.

According to the Florida Law and The Lease Mrs Masso signed it states the following:

Security deposits and advance rent: landlord shall hold the money in separate interest-bearing or non interest-bearing account in a FLORIDA BANK INSTITION for the benefit of Tenant.

Landlord cannot mix such money with any other funds of Landlord or pledge,mortgage or make any other use of such money.

The property in question is in Hallandale Beach Florida at 200 Leslie Drive unit 1025.. In January when the air conditioner broke, i advised Mrs Masso via email while she was on vacation in Colombia, where she has another home. She ask me to get a quote so I got several quotes for repairs. The repairs are between $2200-$4500 for a NEW unit it can not be repaired the unit is shot. It's the end of February and still no A/C. Mrs Masso said she has No money and has already spent my last/ security and pet deposit, maybe on one of her trips to Colombia. Mrs Masso has money to travel to Colombia but No money to take care of her tenants. I found the property for sale online and then I called her realtor, who then confirmed yes Mrs Masso is in severe financial difficulties.The property is going to be for sale as a short sale. He also said she would be calling me to work something out, I'm STILL waiting. Mrs Masso has not returned my call!!! If you are interested in purchasing this unit from Luz Masso the air conditioner DOES NOT work. The add says new pergo floors that is also not true, the floors have lots of wear n tear from previous tenants. Panoramic views of city and inter-coastal, there is a tiny view of the water from the far corner of the patio, I will show on at a later time. Completely updated kitchen maybe in the 80's the kitchen needs to be updated to the year 2010. The washer/dryer is located in a closet with no door as soon as you walk into the bedroom. It looks very odd and not to mention you will also get lots of dryer lint in your room .Since having no A/C we have had to sleep with the windows open and lots of fans its Florida. We are not smokers however the neighbor's are ,we constantly smell cigarette smoke at all hours of the day/night. The neighbors on one side fight at lease once a week very Loud. And above the unit well heavy walkers at all hours. If this appeals to you then make Mrs Masso an offer so we can both move on with our lives..

Dear Ms Masso

I wanted to take a moment and contact you regarding the condominium we rent from you since we have not heard from you and you haven't returned any of our calls. We are very disappointed with the way you have handle this situation and the way you have treated us. The air conditioning has been broken since February 2, 2010 and we have been patient with you because we understand having financial difficulties is not easy but in saying that we have the same difficulties you do except we have no A/C, no money since you spent our deposits already or a place to live in 2 months time and lets not forget the heat we have to endure living in Florida.


Mrs Masso according to the terms of the lease you had 7 days to repair the air or all monies paid in advanced had to be returned (below is the schedule of the amounts). As per the renters agreement that money must be held in a Florida bank account. We already spoke with your realtor Michael he said all monies were already paid to you and not to mention you already put the condo on short sale and we found out not because anyone told us but because we happen to see it online even though you told me you were not going to do that. You said to me that you would be honest and upfront about everything with us however you have not been. What we are asking is for all monies paid in advanced and the February payment that should have been applied towards the a/c repair to be returned immediately so we can move out and move on. We have consulted an attorney and he advised us that we write this letter as a last effort before we proceed with legal action. Ms Masso we are
prepared to do whatever we have to get this money back. You are not simply going to take our money and walk away and leave us high and dry. What you have done is borderline criminal and your financial problems are not and excuse.


We have also started a campaign to let others know about you and your business dealings and the beautiful updated condo your selling. If you would like to see for yourself just google your name. What we are hoping for is that we can resolve this issue before any further legal action be taken and we can settle this like adults..

Your security deposit is the property of the tenant held by the landlord until a claim is made against it. If you are not getting your security deposit returned I would recommend an attorney since the landlord will have to pay your legal fees if you win. You will have to prove the amount of the security deposit by receipt or by acknowledgement in you lease. I would bring this as an action for declaratory relief for the simple reason that if you bring a small claims case you will get a paper called “judgment” that you will have to collect. If you can get the judge to declare that the security deposit is the property of the tenant and orders the landlord to return your security deposit your landlord must return it or he/she will be in contempt of Court. You may also be able to amend your complaint to add a claim for civil theft if your landlord does not return the security deposit after you give the landlord proper notice before filing the claim. Civil theft carries a penalty of 3X the amount. It is likely you will get your security deposit returned if you landlord is subject to a penalty and/or contempt of Court.

Im sorry but that is just wrong and the nerve to try and sell the place without even trying to workout a payment with you. Hey everyone please boycott this condo and the Realtor for being an enabler and allowing this illegal act of lets face it theft go on..Im sorry that you and your family are going through this..god bless

wow I cant believe landlords do this kind of thing dont they know they are hurting other human beings. Well let me tell you get an attorney asap. I had the same thing happen to me and let me tell you my attorney got me all my money back plus court and attorney fees and I was able to get even moving money...Dont take this lying down you have a case good luck

There are ways to get your money back. Do research online.

*File a complaint, small claims court even a lean on her property, check out some of those options. Good Luck.

How awful that a landlord who has willing & knowingly entered into a legal agreement with an honest tenant has faltered on her end of the deal. Hopefully, she can be forced to make the situation right & lessen the burdon on the unsuspecting & honest tenant.

Wow....Shame on Her...I had a similar problem, you should get an attorney and fight for your money. I did and I ended up receiving more money back. Best of Luck to you.
